TERMS OF USE for V-HK (行義香港)  

Use of this website, www.volunteering.org.hk (or www.v-hk.org.hk) and all pages in this domain (together, the "V-HK Website"), constitutes acceptance of the following terms and conditions (“Terms of Use”). The Agency for Volunteer Service (“AVS”) reserves the right to seek all remedies available by law for any violation of these Terms of Use, including any violation of AVS’ rights in the AVS and V-HK names and logos and its rights in connection with the information, artwork, text, video, audio, or pictures (together, the "Content") of the V-HK Website.

These Terms of Use are a legal agreement between you and AVS. AVS provides the V-HK Website for your use in consideration of your provision of information to AVS and/or your use of the V-HK Website. By accessing and using the AVS Website, you signify that you agree to these Terms of Use. If you do not agree to these Terms of Use, please do not use the AVS Website. These Terms of Use apply regardless of whether you access the AVS Website through a computer, a mobile device or otherwise.

 

The AVS and V-HK Name and Logos

The AVS and V-HK name and Logos are the exclusive property of AVS. Both names and logos are protected under local law. Unauthorized use is prohibited. They may not be copied or reproduced in any way without the prior written permission of AVS. Requests for permission to use AVS’ name and logos should be emailed to us at avs@avs.org.hk. Any approval for such requests will be granted at AVS’ absolute discretion.

 

The V-HK Website

The V-HK Website is for the purpose of facilitating the mandate of AVS in the promotion of volunteerism, and by doing so allow AVS’ volunteer members and Registered Organization to engage in volunteer referral service, training courses, fundraising events and other activities.

In any event, AVS shall not be responsible for any loss of profit, loss of business, business interruption or loss of business opportunity arising from or in connection with the usage of this Website. All Content of the AVS Website is protected by law including without limitation, the Copyright Ordinance. 

 

Content Disclaimer

The content of the V-HK Website is selected on the basis of AVS’ own criteria and in its own sole discretion. AVS reserves the right at any time to change or discontinue any aspect or feature of the V-HK Website, including but not limited to these Terms of Use, hours of availability and equipment needed for use, or to begin charging for access to the V-HK Website. AVS cannot be deemed liable for any direct and/or indirect loss or damage, whether in contract, tort, breach of statutory duty or otherwise, even if foreseeable, arising from the use of, or inability to use, the V-HK Website or the reliance or use of the information provided on the V-HK Website.

Copyright

AVS reserves all copyrights on material on its Website, including photographs and graphic designs. The use of AVS Internet material for any purpose is prohibited unless prior written permission is obtained.The unauthorized use of the name and logo of AVS or V-HK is against local law, and is expressly forbidden.

 

Your Responsibilities

You agree to only use the V-HK Website in a manner that complies with all applicable laws and regulations and is consistent with these Terms of Use.

 

Account Users

User account holders (HKCV members and Registered Organizations) are required to keep confidential and not to disclose to any third parties their login names and passwords.

 

The use of the account is only for purposes related to the services, activities and events in relation to AVS. 

 

User account holders shall not misuse the services provided by the V-HK site (“Services”) by engaging in any of the following activities

1: probe, scan, or test the vulnerability of any system or network, breach or otherwise circumvent any security or authentication measures;

2: access, tamper with, or use non-public areas or parts of the Services, or shared areas of the Services you haven't been invited to;

3: interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services;

4: use the other system to access the AVS system data.

5: send unsolicited communications, promotions or advertisements, or spam;

6: send altered, deceptive or false source-identifying information, including "spoofing" or "phishing";

7: promote or advertise products or services without appropriate authorization;

8: abuse email and one drive service to earn and benefit;

9: circumvent service limits;

10: publish or share materials that are unlawfully pornographic or indecent, or that contain extreme acts of violence or terrorist activity, including terror propaganda;

11: advocate bigotry or hatred against any person or group of people based on their race, religion, ethnicity, sex, gender identity, sexual orientation, disability, or impairment;

12: harass or abuse personnel or representatives or agents performing services on behalf of AVS;

13: violate the law in any way, including storing, publishing or sharing material that's fraudulent, defamatory, or misleading; or

14: violate the privacy or infringe the rights of others.

 

Violation of these Terms of Use of the user accounts will result in the immediate suspension or termination of the access to the V-HK portal, and in the event of repeated violations, a termination of the Hong Kong Community Volunteers or Registered Organizations membership.

 

Miscellaneous

These Terms of Use make up the entire agreement between you and AVS and shall supersede any and all prior verbal and written agreements in relation to the V-HK Website or the use of the services provided by us through the V-HK Website. These Terms of Use do not create any third party rights and any rights under the Contract (Rights of Third Parties) Ordinance are hereby excluded.

No failure or delay by AVS or you at any time to exercise any right or remedy provided under these terms of use or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.

Part or all of any provision under these Terms of Use that is illegal or unenforceable will be severed from these Terms of Use and the remaining provisions shall continue in full force and effect.

 

Language

These Terms of Use are drafted in the English language. In the event of any inconsistency between the English language version and any translated version of these terms of use, the English language version shall prevail.

 

Changes

We may change these Terms of Use at any time. If we make any material changes, we will provide you with [14 days'] notice in advance of such changes by highlighting the changes on the V-HK Website. You are entitled to discontinue your use of the V-HK Website at any time.

You should check these Terms of Use periodically to take notice of any changes made. Your continued use of the V-HK Website following the lapse of the [14 days] notification term will signal your acceptance of such changes.

 

Law and Dispute Resolution

In the event of a dispute, please note that these Terms of Use shall be exclusively governed by the laws of Hong Kong and the both parties shall submit any dispute or claim to the exclusive jurisdiction of the courts of Hong Kong.
